Willkommen bei PIZZART, ein Onlineshop auf der Hosting-Plattform Squarespace!
Zu beachten: Verträge auf diesem Portal können ausschließlich in deutscher Sprache abgeschlossen werden. Eine Englische Fassung dient lediglich der Information.
§ 1 Geltungsbereich und Anbieter
(1) Die Allgemeinen Geschäftsbedingungen (nachfolgend „AGB" genannt) regeln den Verkauf
von Produkten durch Magda Hodea Porträtzeichnung (nachfolgend Anbieter) an Sie, in ihrer
zum Zeitpunkt der Bestellung gültigen Fassung.
(2) Abweichende AGB des Bestellers werden zurückgewiesen.
(3) Bitte lesen Sie diese Bedingungen aufmerksam, bevor Sie eine Bestellung an Magda
Hodea Porträtzeichnung aufgeben. Durch Aufgabe einer Bestellung an Magda Hodea
Porträtzeichnung erklären Sie sich mit der Anwendung dieser Verkaufsbedingungen auf Ihre
Bestellung einverstanden.
(4) Auf PIZZART, ein Onlineshop auf der Hosting-Plattform Squarespace bieten wir Ihnen den
Verkauf von folgenden Produkten an:

§ 2 Zustandekommen des Vertrages
(1) Verträge auf diesem Portal können ausschließlich in deutscher Sprache abgeschlossen
werden. Eine Englische Fassung dient lediglich der Information.
(2) Die Angebote richten sich ausschließlich an Endkunden mit einer Rechnungs- und
Lieferanschrift in:
der Europäischen Union.
Bei einzelnen Sperrgutartikeln können die möglichen Lieferadressen sowie der
Ablieferungsort beschränkt sein; die Beschränkung ist im jeweiligen Listenpreis ausgewiesen.
(3) Der Besteller muss das 18. Lebensjahr vollendet haben.
(4) Die Präsentation der Waren im Online-Shop stellt kein rechtlich wirksames Angebot dar.
Durch die Präsentation der Ware wird der Kunde lediglich dazu aufgefordert ein Angebot zu
machen.
(5) Ihre Bestellung stellt ein Angebot an PIZZART, ein Onlineshop auf der Hosting-Plattform
Squarespace zum Abschluss eines Kaufvertrages dar. Der Besteller gibt ein verbindliches
Angebot ab, wenn er den Online-Bestellprozess unter Eingabe der dort verlangten Angaben
durchlaufen hat und im letzten Bestellschritt den Button "zahlungspflichtig bestellen"
anklickt.
(6) Der Kaufvertrag zwischen dem Anbieter und dem Besteller kommt erst durch eine
Annahmeerklärung des Anbieters zustande. Diese erfolgt zum früheren der beiden Termine,
entweder Zusendung der Ware oder Zusendung einer Versandbestätigung per E-Mail.
Beachten Sie, dass die Bestätigung über den Eingang Ihrer Bestellung keine
Annahmeerklärung im zuvor genannten Sinne darstellt.
(7) Die Wirksamkeit von Verträgen über größere als haushaltsübliche Mengen sowie der
gewerbliche Weiterverkauf des Kaufgegenstands bedarf der ausdrücklichen Bestätigung
seitens des Anbieters. Dies bezieht sich sowohl auf die Anzahl der bestellten Produkte im
Rahmen einer Bestellung als auch auf die Aufgabe mehrerer Bestellungen desselben
Produkts, bei denen die einzelnen Bestellungen eine haushaltsübliche Menge umfassen.
(8) Ihre Bestellungen werden bei uns nach Vertragsschluss gespeichert. Sollten Sie Ihre
Unterlagen zu Ihren Bestellungen verlieren, wenden Sie sich bitte per E-Mail oder Telefon an
uns. Wir senden Ihnen eine Kopie der Bestelldaten zu.
§ 3 Preise und Versandkosten
(1) Unsere Preise beinhalten die jeweils gültige gesetzliche Mehrwertsteuer und verstehen
sich mit Versandkostenpauschale und Versandkostenzuschlag. Die Versandkostenzuschläge
variieren je nach Lieferart und Artikelbeschaffenheit.
(2) Trotz unserer größten Bemühungen kann eine kleine Anzahl der Produkte in unserem
Katalog mit dem falschen Preis ausgezeichnet sein. Wir überprüfen die Preise, wenn wir Ihre
Bestellung bearbeiten und bevor wir die Rechnung stellen. Wenn ein Produkt mit einem
falschen Preis ausgezeichnet ist und der korrekte Preis höher ist, als der Preis auf der
Webseite, werden wir Sie vor Versand der Ware kontaktieren, um Sie zu fragen, ob Sie das
Produkt zum korrekten Preis kaufen oder die Bestellung stornieren möchten. Sollte der
korrekte Preis eines Produkts niedriger sein, als der von uns angegebene Preis, werden wir
den niedrigeren Betrag berechnen bzw. eine Teilrückerstattung vornehmen und Ihnen das
Produkt zusenden. Bitte beachten Sie, dass eine Rückerstattung gemäß der Hosting-
Plattform Squarespace und den Finanzdienstleistern zusätzlich 5 bis 10 Werktagen ab
Initiierung der Transaktion durch PIZZART in Anspruch nimmt.
(3) Es gelten die Preise zum Zeitpunkt der Bestellung. Falls Listenpreise vorhanden sein
sollten, gelten die Preise des zum Zeitpunkt der Bestellung gültigen Listenpreises.
§ 4 Lieferung und Stornierung
(1) Sofern nicht anders vereinbart, erfolgt die Lieferung an die vom Besteller angegebene
Lieferadresse. Auf der Webseite finden Sie Hinweise zur Verfügbarkeit von Produkten, die
von PIZZART, ein Onlineshop auf der Hosting-Plattform Squarespace verkauft werden (z.B.
auf der jeweiligen Produktdetailseite). Wir weisen darauf hin, dass sämtliche Angaben zu
Verfügbarkeit, Versand oder Zustellung eines Produktes lediglich voraussichtliche Angaben
und ungefähre Richtwerte sind. Sie stellen keine verbindlichen bzw. garantierten Versandoder
Liefertermine dar, außer wenn dies bei den Versandoptionen des jeweiligen Produktes
ausdrücklich als verbindlicher Termin bezeichnet ist.
(2) Sofern PIZZART, ein Onlineshop auf der Hosting-Plattform Squarespace während der
Bearbeitung Ihrer Bestellung feststellt, dass von Ihnen bestellte Produkte nicht verfügbar
sind, werden Sie darüber gesondert per E-Mail oder per Nachricht in Ihrem Kundenkonto
informiert. Die gesetzlichen Ansprüche des Bestellers bleiben unberührt.
(3) Soweit eine Lieferung an den Besteller nicht möglich ist, weil die gelieferte Ware nicht
durch die Eingangstür, Haustür oder den Treppenaufgang des Bestellers passt oder weil der
Besteller nicht unter der von ihm angegebenen Lieferadresse angetroffen wird, obwohl der
Lieferzeitpunkt dem Besteller mit angemessener Frist angekündigt wurde, trägt der Besteller
die Kosten für die erfolglose Anlieferung.
(4) Die Lieferung erfolgt je nach Zahlungsart des Kunden. Bei Vorkasse erfolgt die Lieferung
nach der Erteilung des Zahlungsauftrags an das überweisende Kreditinstitut. Bei Zahlung per
Paypal, Kreditkarte, Geschenkkarte, Lastschrift, Sofortüberweisung oder Rechnung erfolgt
die Lieferung nach Vertragsschluss.
(5) Wenn Ihre Bestellung in mehr als einem Paket versendet wird, kann es vorkommen, dass
Sie für jedes Paket eine eigene Versandbestätigung erhalten. In diesem Fall kommt bezüglich
jeder Versandbestätigung ein separater Kaufvertrag zwischen uns über die in der jeweiligen
Versandbestätigung aufgeführten Produkte zustande. Vertragspartner ist Magda Hodea
Porträtzeichnung. Ungeachtet Ihres Widerrufsrechts können Sie Ihre Bestellung für ein
Produkt vor Zusendung der zugehörigen Versandbestätigung
jederzeit kostenfrei stornieren.
§ 5 Zoll
(1) Wenn Sie Produkte bei PIZZART, ein Onlineshop auf der Hosting-Plattform Squarespace
zur Lieferung außerhalb der Europäischen Union bestellen, können Sie Importzöllen und -
steuern unterliegen, die erhoben werden, sobald das Paket den bestimmten Zielort erreicht.
Jegliche zusätzlichen Gebühren für die Zollabfertigung müssen von Ihnen getragen werden;
wir haben keinen Einfluss auf diese Gebühren. Zollregelungen unterscheiden sich stark von
Land zu Land, so dass Sie Ihre örtliche Zollbehörde für nähere Informationen kontaktieren
sollten.
(2) Ferner beachten Sie bitte, dass Sie bei Bestellungen bei PIZZART, ein Onlineshop auf der
Hosting-Plattform Squarespace als Einführender angesehen werden und alle Gesetze und
Verordnungen des Landes, in dem Sie die Produkte erhalten, einhalten müssen. Der Schutz
Ihrer Daten ist wichtig für uns und wir möchten unsere internationalen Kunden darauf
aufmerksam machen, dass grenzüberschreitende Lieferungen der Öffnung und
Untersuchung durch Zollbehörden unterliegen.
§ 6 Zahlung
(1) Der Besteller kann die Ware durch folgende Zahlungsarten bezahlen:
- Paypal
- Credit card
(2) Bestimmte Zahlungsarten können im Einzelfall von dem Anbieter ausgeschlossen werden.
(3) Dem Besteller ist nicht gestattet die Ware durch das Senden von Bargeld oder Schecks zu
bezahlen.
(4) Sollte der Besteller ein Online-Zahlungsverfahren wie PayPal oder Kreditkarte wählen,
ermächtigt der Besteller den Anbieter dadurch, die fälligen Beträge zum Zeitpunkt der
Bestellung einzuziehen.
(5) Sollte der Anbieter die Bezahlung per Vorkasse anbieten und der Besteller diese
Zahlungsart wählen, hat der Besteller den Rechnungsbetrag innerhalb von fünf
Kalendertagen nach Eingang der Bestellung, auf das Konto des Anbieters zu überweisen. Der
Anbieter reserviert die Ware dementsprechend für fünf Kalendertage.
(6) Sollte der Anbieter die Bezahlung per Lastschrift anbieten und der Besteller diese
Zahlungsart wählen, erteilt der Besteller dem Anbieter ein SEPA Basismandat. Sollte es bei
der Zahlung per Lastschrift zu einer Rückbuchung einer Zahlungstransaktion mangels
Kontodeckung oder aufgrund falsch übermittelter Daten der Bankverbindung kommen, so
hat der Besteller dafür die Kosten zu tragen.
(7) Sollte der Anbieter den Kauf auf Rechnung anbieten und der Besteller diese Zahlungsart
wählen, verpflichtet sich der Besteller, den Rechnungsbetrag innerhalb von 14 Tagen nach
Warenversand, ohne jeglichen Abzug von Skonto zu begleichen.
(8) Sollte der Besteller mit der Zahlung in Verzug kommen, so behält sich der Anbieter die
Geltendmachung des Verzugschadens vor.
§ 7 Aufrechnung und Zurückbehaltungsrecht
(1) Dem Besteller steht das Recht zur Aufrechnung nur zu, wenn die Gegenforderung des
Bestellers rechtskräftig festgestellt worden ist oder von dem Anbieter nicht bestritten
wurde.
(2) Der Besteller kann ein Zurückbehaltungsrecht nur ausüben, soweit Ihre Gegenforderung
auf demselben Vertragsverhältnis beruht.
§ 8 Eigentumsvorbehalt
Magda Hodea Porträtzeichnung behält sich das Eigentum an der Ware bis zur vollständigen
Bezahlung vor (inklusive der Versandkosten).
§ 9 Transportschäden
(1) Sollte der Besteller die Ware mit offensichtlichen Transportschäden erhalten, so fordert
der Anbieter ihn dazu auf diese schnellstmöglich zu reklamieren.
(2) Sollte der Besteller die Reklamation versäumen, hat dies keine Konsequenzen auf die
gesetzlichen Gewährleistungsrechte. Die Reklamation bezweckt, dass der Anbieter seine
eigenen Ansprüche gegenüber dem Frachtführer geltend machen kann.
§ 10 Mängelrecht
(1) Ist der Besteller ein Verbraucher, so richtet sich die Gewährleistung und Mängelhaftung
des gelieferten Kaufgegenstandes nach den gesetzlichen Vorschriften: Demnach haben
Besteller in der Europäischen Union zusätzlich zu Ihrem 14-tägigen Widerrufsrecht
Gewährleistungsrechte für einen Zeitraum von zwei Jahren ab der Lieferung der Ware und
können die Reparatur der auf PIZZART, ein Onlineshop auf der Hosting-Plattform
Squarespace gekauften Produkte verlangen, wenn diese sich als mangelhaft oder nicht wie
beschrieben erweisen. Wenn die Ware nicht innerhalb einer angemessenen Zeit oder nicht
ohne Schwierigkeiten repariert oder ersetzt werden kann, können Sie die Rückerstattung
oder Minderung des Kaufpreises verlangen. Bitte beachten Sie, dass eine Rückerstattung
gemäß der Hosting-Plattform Squarespace und den Finanzdienstleistern innerhalb von 5 bis
10 Werktagen ab Initiierung der Transaktion durch PIZZART in Anspruch nimmt.
(2) Im Fall von gebrauchten Waren kann die Gewährleistungsfrist kürzer als zwei Jahre sein.
(3) Ist der Besteller kein Verbraucher, so wird der Mangel durch Nachbesserung oder
Nachlieferung beseitigt (Rückversand diesbezüglich erforderlich).
(4) Ist der Besteller kein Verbraucher so beträgt die Verjährungsfrist ein Jahr. Dies gilt soweit
keine Schadens- und Aufwendungsersatzansprüche, die sich auf Ersatz eines Schadens in
Bezug auf Körper und Gesundheit oder auf Vorsatz oder grobe Fahrlässigkeit geltend
gemacht werden.
§ 11 Haftungsbegrenzung (Produkte)
(1) Der Anbieter haftet für Schadensersatzansprüche des Bestellers aus der Verletzung des
Lebens, des Körpers, der Gesundheit oder aus der Verletzung wesentlicher Vertragspflichten,
sowie für sonstige Schäden, die auf ihrer vorsätzlichen oder grob fahrlässigen
Pflichtverletzung, oder einer der gesetzlichen Vertreter oder Erfüllungsgehilfen des
Anbieters beruhen.
Sollte der Besteller explizit den Wunsch äußern, ein Ölgemälde vor der erforderlichen und
von uns empfohlenen Lackierung in Besitz zu nehmen, behalten wir uns das Recht, die
Gewährleistungsansprüche zu verweigern. Wir empfehlen dringend, die Lackierung
mindestens 6 Monate nach dem Auspacken auf das getrocknete Gemälde aufzubringen.
(2) Als wesentliche Vertragspflichten, gelten Pflichten deren Erfüllung zur Erreichung des
Ziels des Vertrags notwendig ist.
(3) Der Anbieter haftet für Verletzungen wesentlicher Vertragspflichten, die auf
vertragstypischen, vorhersehbaren Schäden beruhen, vorausgesetzt der Schaden wurde
einfach fahrlässig verursacht. Diese Begrenzung gilt nicht für Schadensersatzansprüche des
Bestellers, die auf einer Verletzung des Lebens, des Körpers oder der Gesundheit beruhen.
(4) Die Vorschriften des Produkthaftungsgesetzes bleiben unberührt.
(5) Soweit die Haftung von PIZZART, ein Onlineshop auf der Hosting-Plattform Squarespace
ausgeschlossen oder beschränkt ist, gilt dies auch für die persönliche Haftung von
Arbeitnehmern, Vertretern und Erfüllungsgehilfen.
§ 12 Widerrufsbelehrung
(1) Ist der Besteller ein Verbraucher, so hat er ein Widerrufsrecht nach Maßgabe der
folgenden Bestimmungen:

Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu
widerrufen.
Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag, an dem Sie oder ein von Ihnen
benannter Dritter, der nicht der Beförderer ist, die Ware (oder die letzte Ware, Teilsendung
oder Stück im Falle eines Vertrags über mehrere Waren einer einheitlichen Bestellung oder
die Lieferung einer Ware in mehreren Teilsendungen oder Stücken) in Besitz genommen
haben, ohne Angabe von Gründen zu widerrufen.
Um Ihr Widerrufsrecht auszuüben, müssen Sie uns:

mittels einer eindeutigen Erklärung (z. B. ein mit der Post versandter Brief, Telefax oder EMail)
über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das
Muster-Widerrufsformular auf unserer Internetseite verwenden (weiter unten auf dieser Seite) oder uns eine andere
eindeutige Erklärung übermitteln. Machen Sie von dieser Möglichkeit Gebrauch, so werden
wir Ihnen unverzüglich (z.B. per E-Mail) eine Bestätigung über den Eingang eines solchen
Widerrufs übermitteln.
Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des
Widerrufsrechts vor Ablauf der Widerrufsfrist absenden und Sie die Waren über innerhalb
der unten definierten Frist zurückgesendet haben.
Es reicht, dass Sie uns einen Nachweis des Rückversands senden.
(3) Folgen des Widerrufs
Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen
erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die
sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene,
günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen 14 Tagen
ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei
uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie
bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde
ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser
Rückzahlung Entgelte berechnet.
Wir können die Rückzahlung verweigern, bis wir die Waren wieder zurückerhalten haben
oder bis Sie den Nachweis erbracht haben, dass Sie die Waren zurückgesandt haben, je
nachdem, welches der frühere Zeitpunkt ist.
Sie haben die Waren unverzüglich und in jedem Fall spätestens binnen 14 Tagen ab dem Tag,
an dem Sie uns über den Widerruf dieses Vertrags unterrichten, an

zurückzusenden oder zu übergeben. Die Frist ist gewahrt, wenn Sie die Waren vor Ablauf der
Frist von 14 Tagen absenden. Bitte beachten Sie, dass eine Rückerstattung gemäß der
Hosting-Plattform Squarespace und den Finanzdienstleistern zusätzlich 5 bis 10 Werktagen
ab Initiierung der Transaktion durch PIZZART in Anspruch nimmt. Sie tragen die
unmittelbaren Kosten der Rücksendung der Waren.
(4) Ausnahmen vom Widerrufsrecht
Sie müssen für einen etwaigen Wertverlust der Waren nur aufkommen, wenn dieser
Wertverlust auf einen zur Prüfung der Beschaffenheit, Eigenschaften und Funktionsweise der
Waren nicht notwendigen Umgang mit ihnen zurückzuführen ist.
Sollte etwas auf dem Postweg beschädigt werden, weil Sie das Päckchen oder die Ware nicht
sicher verpackt haben, müssen Sie den Schaden an der Ware bezahlen. Deshalb empfehlen
wir, dass Sie die Ware vor dem Rückversand fotografieren, wie folgt: einmal die Ware direkt
vor Schließung der Verpackung und einmal das fertige Paket. Außerdem empfehlen wir,
dieselbe Verpackung oder Art der Verpackung wie die originale zu verwenden. Bitte
informieren Sie sich bei dem gewählten Lieferdienst darüber, wie Sie die Ware sicher
verpacken.
Das Widerrufsrecht besteht nicht bzw. erlischt bei folgenden Verträgen:
zur Lieferung von Waren, die nach Kundenspezifikation angefertigt werden oder
eindeutig auf die persönlichen Bedürfnisse zugeschnitten sind;
bei Dienstleistungen, wenn PIZZART, ein Onlineshop auf der Hosting-Plattform
Squarespace diese vollständig erbracht hat und Sie vor der Bestellung zur Kenntnis
genommen und ausdrücklich zugestimmt haben, dass wir mit der Erbringung der
Dienstleistung beginnen können und Sie Ihr Widerrufsrecht bei vollständiger
Vertragserfüllung verlieren;
zur Lieferung von Zeitungen, Zeitschriften oder Illustrierte, mit Ausnahme von
Abonnement-Verträgen;
§ 14 Gerichtsstand und anwendbares Recht
(1) Für Meinungsverschiedenheiten und Streitigkeiten anlässlich dieses Vertrages gilt
ausschließlich das Recht der Bundesrepublik Deutschland unter Ausschluss des UNKaufrechts.
(2) Alleiniger Gerichtsstand bei Bestellungen von Kaufleuten, juristischen Personen des
öffentlichen Rechts oder öffentlich-rechtlichen Sondervermögen ist der Sitz des Anbieters.
§ 15 Schlussbestimmungen
(1) Vertragssprache ist deutsch. Die Englische Fassung dient lediglich der Information.
(2) Wir bieten keine Produkte oder Dienstleistungen zum Kauf durch Minderjährige an.
Unsere Produkte für Kinder können nur von Erwachsenen gekauft werden. Falls Sie unter 18
sind, dürfen Sie PIZZART, ein Onlineshop auf der Hosting-Plattform Squarespace nur unter
Mitwirkung eines Elternteils oder Erziehungsberechtigten nutzen.
(3) Wenn Sie diese AGB verletzen und wir unternehmen hiergegen nichts, sind wir weiterhin
berechtigt, von unseren Rechten bei jeder anderen Gelegenheit, in der Sie diese
Verkaufsbedingungen verletzen, Gebrauch zu machen.
(4) Wir behalten uns das Recht vor, Änderungen an unserer Webseite, Regelwerken,
Bedingungen einschließlich dieser AGB jederzeit vorzunehmen. Auf Ihre Bestellung finden
jeweils die Verkaufsbedingungen, Vertragsbedingungen und AGB Anwendung, die zu dem
Zeitpunkt Ihrer Bestellung in Kraft sind, es sei denn eine Änderung an diesen Bedingungen ist
gesetzlich oder auf behördliche Anordnung erforderlich (in diesem Fall finden sie auch auf
Bestellungen Anwendung, die Sie zuvor getätigt haben). Falls eine Regelung in diesen
Verkaufsbedingungen unwirksam, nichtig oder aus irgendeinem Grund undurchsetzbar ist,
gilt diese Regelung als trennbar und beeinflusst die Gültigkeit und Durchsetzbarkeit der
verbleibenden Regelungen nicht.
(5) Die Unwirksamkeit einer Bestimmung berührt die Wirksamkeit der anderen
Bestimmungen aus dem Vertrag nicht. Sollte dieser Fall eintreten, soll die Bestimmung nach
Sinn und Zweck durch eine andere rechtlich zulässige Bestimmung ersetzt werden, die dem
Sinn und Zweck der unwirksamen Bestimmung entspricht.

§ 1 Area of applicability and provider
(1) The General Terms and Conditions (hereinafter referred to as "Terms and Conditions")
govern the sale of products by Magda Hodea Porträtzeichnung (hereinafter referred to as
"Supplier") to you, in the version valid at the time of the order.
(2) Deviating terms and conditions of the purchaser shall be rejected.

Porträtzeichnung. By placing an order with Magda Hodea Porträtzeichnung, you agree to
the application of these terms and
conditions to your order.
(4) On PIZZART, an online shop on the hosting platform Squarespace, we offer you the sale of the
following products:

§ 2 Conclusion of the contract
(1) Contracts on this portal may only be concluded in German. An English version is for
information only.
(2) The offers are addressed exclusively to final customers with a billing and delivery address
in:
the European Union.
For individual bulky goods, the possible delivery addresses as well as the place of delivery may be
limited; the limitation is indicated in the respective list price.
(3) The purchaser must be at least 18 years of age.
(4) The presentation of the goods in the online shop does not constitute a legally
effective offer. By presenting the goods, the customer is merely invited to
make an offer.
(5) Your order constitutes an offer to PIZZART, an online shop on the hosting platform
Squarespace for the conclusion of a purchase contract. The customer submits a binding
offer if he has gone through the online ordering process by entering the information
requested there and in the final ordering step clicks the button
"order subject to payment".
(6) The purchase contract between the supplier and the customer is only concluded by a
declaration of acceptance by the customer. This takes place on the earlier of the two
dates, either dispatch of the goods or sending a shipping confirmation by e-mail. Please
note that the confirmation of receipt of your order does not constitute a declaration of
acceptance in the sense mentioned above.
(7) The validity of contracts for larger than usual quantities as well as the commercial resale
of the object of purchase requires the express confirmation by the supplier.
This applies both to the number of products ordered in one order and to the placing of several
orders for the same product, each of which covers
a normal household quantity.
(8) Your orders will be stored with us after conclusion of the contract. If you lose your order
documents, please contact us by e-mail or phone. We will send you a copy of the order
details.
§ 3 Prices and shipping costs
(1) Our prices include the applicable statutory value added tax and include shipping charges
and shipping surcharge. The shipping surcharges vary depending on the type of delivery and
the nature of the item.
(2) Despite our best efforts, a small number of products in our catalogue may be marked
with the wrong price. We check the prices when we process your order and before we issue
the invoice. If a product is marked with an incorrect price and the correct price is higher than
the price on the website, we will contact you before shipping the goods to ask you if you
would like to buy the product at the correct price or cancel the order. If the correct price of a
product is lower than the price quoted by us, we will charge the lower amount or rather
make a partial refund and send the product to you. Please note that according to the hosting
platform Squarespace and the financial service providers, the refund will take place within 5
to 10 business days from the initiation of
the transaction by PIZZART (this period is to be
considered in addition).
(3) The prices at the time of the order are valid. If list prices are available, the prices of the
list price valid at the time of the order shall apply.
§ 4 Delivery and cancellation
(1) Unless otherwise agreed, delivery shall be made to the delivery address specified by the
customer. On the website you will find information on the availability of products sold by
PIZZART, an online shop on the hosting platform Squarespace (e. g. on the respective
product detail page). We would like to point out that all information regarding availability,
shipment or delivery of the products is merely estimated information and approximate
guidelines. They do not constitute binding or guaranteed shipping or delivery dates,
unless this is expressly indicated as a binding date
in the shipping options of the respective product.
(2) If PIZZART, an online shop on the hosting platform Squarespace, notices during the
processing of your order that the products you have ordered are unavailable, you will be
notified separately by e-mail or by message in your customer account. The legal claims of the
purchaser remain unaffected.
(3) Insofar as delivery to the purchaser is not possible because the delivered goods do not fit
through the purchaser's front door, front door or staircase or because the purchaser is not
found at the delivery address indicated by him, although the delivery date has been
announced to the purchaser within a reasonable period of time, the purchaser shall bear the
costs of unsuccessful delivery.
(4) The delivery takes place according to the payment method of the customer. In the case
of prepayment, the dispatchment takes place after the payment order has been issued to
the transferring credit institution. In case of payment by Paypal, credit card, gift card, direct
debit, immediate transfer or invoice, the delivery takes place after conclusion of the
contract.
(5) If your order is shipped in more than one package, you may receive a separate shipping
confirmation for each package. In this case, a separate purchase contract is concluded
between us for the products listed in the respective shipping confirmation for each shipment

cancellation, you may cancel your order for a product at any time free of charge before
sending the corresponding shipping confirmation.
§ 5 Zoll
(1) If you order products from PIZZART, an online shop on the Squarespace hosting platform
for delivery outside the European Union, you may be subject to customs duties and taxes,
which are levied as soon as the package reaches the specified destination. Any additional
fees for customs clearance must be borne by you; we have no control on these charges.
Customs policies vary widely from country to country,
so you should contact your local
customs authority for more information.
(2) Furthermore, please note that when ordering from PIZZART, an online shop on the
hosting platform Squarespace, you are considered to be the importer and must comply with
all laws and regulations of the country in which you receive the products. The protection of
your data is important to us and we would like to draw the attention of our international
customers to the fact that cross-border shipments are subject to opening and investigation
by customs authorities.
§ 6 Payment
(1) The purchaser may pay for the goods by the following methods of payment:
- Paypal
- Credit card
(2) Certain types of payment may be excluded by the provider on a case-by-case basis.
(3) The purchaser is not permitted to pay for the goods by sending
cash or cheques.
(4) If the purchaser chooses an online payment method such as PayPal or credit card, the
purchaser hereby authorizes the supplier to collect the amounts due at the time of the
order.
(5) If the supplier offers payment by prepayment and the purchaser chooses this method of
payment, the purchaser shall transfer the invoice amount to the Supplier's account within
five calendar days of receipt of the order. The supplier reserves the goods accordingly for
five calendar days.
(6) If the supplier offers payment by direct debit and the purchaser chooses this payment
method, the purchaser shall grant the supplier a SEPA basic mandate. If payment by direct
debit should result in a reversal of a payment transaction due to lack of account cover or due
to incorrectly transmitted bank details,
the purchaser shall bear the costs.
(7) Should the supplier offer payment on account and the purchaser chooses this method of
payment, the purchaser undertakes to pay the invoice amount within 14 days after dispatch
of the goods, without any deduction of any discount.
(8) Should the purchaser be in default of payment, the supplier reserves the right to assert
the delay damage.
§ 7 Offsetting and Right of Retention
(1) The purchaser is only entitled to set-off if the counterclaim of the purchaser has been
recognized in a legally effective manner and is
undisputed by the supplier.
(2) The purchaser may only exercise a right of retention if your counterclaim is based on the
same contractual relationship.
§ 8 Reservation of title
Magda Hodea Porträtzeichnung retains ownership of the goods
until full payment (includind shipment payment).
§ 9 Transport damage
(1) Should the customer receive the goods with obvious transport damage, the supplier
requires him to complain about them as soon as possible.
(2) Should the purchaser fail to make the complaint, this shall not have any consequences
for the statutory warranty rights. The purpose of the complaint is to enable the supplier to
assert its own claims against the carrier.
§ 10 Right relating to defects
(1) If the purchaser is a consumer, the warranty and liability for defects of the delivered item
of purchase are governed by the statutory provisions: in addition to their 14-day right of
cancellation, purchasers have warranty rights for a period of two years from the delivery of
the goods and may request the repair of the products purchased on PIZZART, an online shop
on the hosting platform Squarespace, if they prove to be defective or not as described. If the
goods cannot be repaired or replaced within a reasonable time or without difficulty, you may
request a refund or reduction of the purchase price. Please note that according to the
hosting platform Squarespace and the financial service providers, the refund will take place
within 5 to 10 business days from the initiation of the transaction by
PIZZART (this period is
to be considered in addition).
(2) In the case of second-hand goods, the warranty period may be less than two years.
(3) If the purchaser is not a consumer, the defect shall be remedied by rectification or
subsequent delivery (return shipment is required in this regard).
(4) If the purchaser is not a consumer, the limitation period shall be one year. This does not
apply insofar as claims for damages and expenses are asserted for compensation of damage
in relation to body and health or
for intent or gross negligence.
§ 11 Limitation of Liability (Products)
(1) The Supplier shall be liable for damages claims of the Purchaser arising from injury to life,
body, health or from the violation of essential contractual obligations, as well as for other
damages which are based on their intentional or grossly negligent breach of duty, or one of
the legal representatives or
vicarious agents of the Supplier.
Should the purchaser explicitly express the wish to take possession of an oil painting prior to
the required and recommended varnishing, we reserve the right to reject warranty claims.
We strongly recommend that the varnishing is made on the dried painting at least 6 months
after unwrapping it.
(2) Obligations the fulfilment of which is necessary to achieve the objective of the contract
shall be regarded as essential contractual obligations.
(3) The provider shall be liable for breaches of essential contractual obligations which are
based on contractual, foreseeable damages, provided that the damage was caused simply
negligently. This limitation does not apply to claims for damages of the purchaser which are
based on injury to life, body or health.
(4) The provisions of the Product Liability Act remain unaffected.
(5) Insofar as the liability of PIZZART, an online shop on the hosting platform Squarespace is
excluded or limited, this also applies to the personal liability of employees, representatives
and vicarious agents.
§ 12 Notice of revocation
(1) If the purchaser is a consumer, he has a right of withdrawal in accordance with the
following provisions:

You have the right to withdraw from this contract within fourteen days without giving
reasons.
The revocation period is fourteen days from the day on which you or a third party
designated by you, other than the carrier, took possession of the goods (or the last goods,

or the delivery of goods in several partial consignments or pieces) without giving reasons for
revocation.

you of your decision to withdraw from this contract by means of a clear statement (e. g. a
letter sent by post, fax or e-mail). You can use the model withdrawal form on our website (at the bottom of this page) or
send us another clear statement.
If you make use of this option, we will immediately (e. g. by
e-mail) send you a confirmation of receipt of
such a revocation.
In order to comply with the withdrawal period, it is sufficient that you send the notification
about the exercise of the right of withdrawal before the expiry of the withdrawal period and
that you have returned the goods within the period defined below.
It is enough that you send us a proof of return shipment.
(3) Consequences of revocation
If you withdraw from this contract, we shall reimburse you all payments we have received
from you, including delivery costs (with the exception of any additional costs resulting from
your choice of a different type of delivery from the cheapest standard delivery offered by
us), without delay and at the latest within 14 days from the day on which we receive
notification of your withdrawal from this contract.
For this refund, we will use the same
means of payment that you used for the original transaction, unless expressly agreed
otherwise with you; in no case will you be charged
any fees for this refund.
We may refuse the refund until we have received the goods back or until you have provided
proof that you have returned the goods,
whichever is the earlier.
You have to return or hand over the goods immediately and in any event no later than 14
days from the day on which you inform us of the withdrawal of this contract, to

The deadline is met if you send the goods before the expiry of the period of 14 days. Please
note that according to the hosting platform Squarespace and the financial service providers,
the refund will take place within 5 to 10 business days from the initiation of the transaction
by PIZZART (this period is to be considered in addition). You bear the direct costs of
returning the goods.
(4) Exceptions to the right of withdrawal
You have to pay for any loss in value of the goods only if the loss in value is due to
handling other than what is necessary to ascertain the nature, characteristics and
functioning of the goods.
If something is damaged on the way because you have not packaged the goods safely, you
must pay for the damage to the goods. Therefore, we recommend that you photograph the
goods before you send them back as follows: once the goods immediately before closing the
packaging and once the finished parcel, ready to ship. We also recommend using the same
packaging or type of packaging as the original. Please inform yourself by the chosen delivery
service on how
to package the goods safely.
The right of withdrawal does not exist or expires in the case of the following contracts:
to supply goods that are manufactured according to customer specifications or are
clearly tailored to personal needs;
in the case of services, if PIZZART, an online shop on the hosting platform Squarespace,
has provided them in full and you have acknowledged and expressly agreed before
placing your order that we may start providing the service and
you will lose your right of
withdrawal if the contract is fully fulfilled;
for the supply of newspapers, magazines or illustrations, with the exception of
subscription contracts;
§ 14 Jurisdiction and applicable law
(1) The law of the Federal Republic of Germany with the exclusion of the UN Sales Law shall
apply exclusively to disagreements and disputes arising from this contract.
(2) The sole place of jurisdiction for orders from merchants, legal persons under public law
or special funds under public law shall be the place of business of the provider.
§ 15 Final provisions
(1) The contract language is German. The English version is for information only.
(2) We do not offer products or services for purchase by minors. Our products for children
can only be purchased by adults. If you are under 18, you may only use PIZZART, an online
shop on the Squarespace hosting platform, with the involvement of a parent or legal
guardian.
3) If you violate these terms and conditions and we do nothing about it, we will still be
entitled to exercise our rights on any other occasion where you violate these Terms and
Conditions of Sale.
(4) We reserve the right to make changes to our website, rules and conditions including
these General Terms and Conditions at any time. The terms of sale, contractual conditions
and General Terms and Conditions in force at the time of your order will apply to your order,
unless a change to these conditions is required by law or by official order (in which case they
will also apply to orders which you have previously made). If any provision in these terms of
sale is invalid, void or for any reason unenforceable,
that provision will be deemed severable
and will not affect the validity and
enforceability of any remaining provisions.
(5) The ineffectiveness of a provision does not affect the effectiveness of the other
provisions of the contract. Should this case occur, the meaning and purpose of the provision
should be replaced by another legally permissible provision that corresponds to the meaning
and purpose of the invalid provision.
